By purchasing, activating, charging, wearing, assembling, or using this wearable vibrational acupressure device
(the “Device”), you acknowledge that you have read, understood, and voluntarily agreed to all terms, warnings,
and conditions set forth below. If you do not agree, do not use the Device and return it unused in its original packaging.

YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, DISCOMFORT, OR OTHER HARM ASSOCIATED WITH USE OR MISUSE OF THIS DEVICE.

1. Assumption Of Risk


Use of vibrational acupressure devices involves inherent and unpredictable risks, including but not limited to skin
irritation, bruising, nerve irritation, muscle soreness, circulatory complications, aggravation of pre-existing
conditions, and other known or unknown injuries. These risks may arise from proper use, improper use, prolonged use,
incorrect placement, or failure to follow instructions.


You acknowledge that individual responses to vibrational stimulation vary and that no representations have been made
regarding the safety or suitability of the Device for your specific condition or use case.

2. Intended Use Only


The Device is intended solely as a general wellness and vibrational acupressure tool intended to provide localized
vibrational stimulation at acupressure points for comfort and relaxation.

THE DEVICE IS NOT A MEDICAL DEVICE.


The Device is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition and is not
a substitute for professional medical advice, diagnosis, or treatment.

3. Restricted Anatomical Zones Do Not Use On

To reduce the risk of injury or medical complications, do not apply the Device to the following areas:

  • The anterior or lateral neck, including the carotid sinus area
  • The head, face, temples, skull, or eyes
  • Directly over the heart or chest cavity
  • Directly on the spine, vertebrae, or coccyx
  • Bony prominences such as kneecaps, elbows, or ankles
  • Genitalia or reproductive organs

The Device is intended for use on muscle tissue and soft tissue areas only.

4. Medical Contraindications


Do not use the Device if you have, or suspect you may have, any of the following conditions unless cleared in advance
by a licensed physician:

  • Deep vein thrombosis, blood clots, or serious circulatory disorders
  • Implanted electronic medical devices, including pacemakers, ICDs, or neurostimulators
  • Pregnancy, particularly on the abdomen or lower back
  • Active cancer or malignancy near the area of use
  • Open wounds, skin infections, rashes, unexplained swelling, or compromised skin integrity

Use of the Device despite these contraindications is done entirely at your own risk.

5. User Responsibilities

You agree to:

  • Read and follow all instructions and warnings prior to use
  • Use the Device only as intended
  • Inspect the Device before each use
  • Discontinue use immediately if pain, numbness, dizziness, or discomfort occurs
  • Avoid use while impaired, fatigued, injured, or ill
  • Limit duration and intensity according to provided guidelines

Failure to follow instructions constitutes misuse.

6. Medical Clearance


You acknowledge that you are solely responsible for determining whether use of the Device is appropriate for you.
You are strongly advised to consult with a licensed physician or qualified healthcare professional before using the Device,
especially if you:

  • Have any pre-existing medical condition
  • Are recovering from injury or surgery
  • Have cardiovascular, neurological, or musculoskeletal conditions
  • Are pregnant or may become pregnant
  • Are taking medications that affect circulation, sensation, or muscle response

Use of the Device without obtaining appropriate medical clearance is done entirely at your own risk.

7. Age Restriction

The Device is primarily intended for use by adults.

CHILDREN AND MINORS:


Acu-Vibes™ may be used with children ages 12 and older only under the strict supervision and direction of a trained
acupressure professional and subject to the following conditions:

  • Maximum session length of up to 10 minutes per session
  • Use must be directly supervised at all times by a trained acupressure professional
  • Acupoint selection, placement, and session duration must be determined by the supervising professional
  • Use must be discontinued immediately if the child experiences discomfort, irritation, dizziness, or distress


Acu-Vibes™ is not intended for unsupervised use by children and must not be used on children under the age of 12
under any circumstances.

8. Battery, Charging, And Adhesive Warnings


The Device contains an internal rechargeable battery and may use adhesives or attachment mechanisms. Improper handling
may result in injury, damage, or malfunction.

You agree to the following:

  • Use only the charging cables, adapters, and power sources specified by the manufacturer
  • Do not overcharge, puncture, crush, disassemble, modify, or expose the battery to heat, water, or fire
  • Do not use the Device if the battery shows signs of swelling, overheating, leakage, or damage
  • Charge the Device only on non-flammable surfaces and never while unattended
  • Discontinue use immediately if the Device becomes excessively hot during operation or charging

Adhesive-related warnings:

  • Adhesives may cause skin irritation, allergic reactions, or discomfort
  • Do not apply adhesives to broken, damaged, or sensitive skin
  • Remove the Device immediately if redness, itching, burning, or irritation occurs
  • Adhesive performance may vary based on skin type, moisture, body hair, or movement

9. No Warranties

THE DEVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”


All warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular
purpose, and non-infringement, are disclaimed to the fullest extent permitted by law.

No guarantee is made regarding performance, results, or safety under all conditions of use.

10. Release Of Liability


To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless the manufacturer, seller,
licensors, officers, employees, contractors, and affiliates from any and all claims, demands, damages, losses, liabilities,
or causes of action arising out of or related to:

  • Use or misuse of the Device
  • Failure to follow instructions or warnings
  • Improper placement or excessive use
  • Allergic reactions, skin reactions, or physiological responses
  • Any manufacturing, design, or informational claims, whether known or unknown

This release applies to claims based on negligence, strict liability, or any other legal theory.

11. Indemnification


You agree to indemnify and hold harmless the manufacturer and its affiliates from any claims, damages, costs, or expenses,
including reasonable attorneys’ fees, arising from your use or misuse of the Device.

12. Governing Law And Venue


This agreement shall be governed by and construed under the laws of the applicable state designated by the manufacturer,
without regard to conflict of law principles. Any disputes shall be resolved exclusively in the appropriate state or
federal courts located within that jurisdiction.

13. Acknowledgment And Return Policy


By using the Device, you acknowledge that you have read and understood this waiver and agree to be bound by its terms.



IF YOU DO NOT AGREE TO THESE TERMS OR HAVE ANY DOUBT ABOUT SAFE USE, DO NOT USE THE DEVICE. RETURN IT UNUSED AND
IN ORIGINAL PACKAGING WITHIN 30 DAYS OF PURCHASE IN ACCORDANCE WITH THE SELLER’S RETURN POLICY.

14. Acu-Vibes App Disclaimer

The Acu-Vibes mobile application (the “App”) is provided solely for general wellness, educational, lifestyle, relaxation, and informational purposes. The App may include acupressure point offerings, soundscapes, educational content related to Traditional Chinese Medicine (“TCM”), emotional wellness tools, seasonal wellness guidance, Five Element educational content, dietary suggestions, and related wellness content.

THE APP IS NOT A MEDICAL APPLICATION AND DOES NOT PROVIDE MEDICAL ADVICE.

The App does not prescribe, direct, or recommend specific acupressure points, dietary practices, or wellness protocols for any medical condition. Users voluntarily choose which acupressure points, wellness content, or educational materials they engage with based on their own personal preferences and discretion.

Any dietary suggestions, Five Element teachings, seasonal wellness content, or Traditional Chinese Medicine concepts provided within the App are offered solely for general educational and informational purposes and are not intended as medical, nutritional, or healthcare advice.

No content within the App is intended to diagnose, treat, cure, mitigate, monitor, or prevent any disease, medical condition, or mental health condition. Information presented within the App should not be considered medical advice and is not a substitute for consultation with a licensed physician, registered dietitian, or qualified healthcare professional.

You acknowledge and agree that:

  • Acu-Vibes makes no guarantees regarding outcomes, effectiveness, or suitability for any individual user

To the fullest extent permitted by law, Acu-Vibes disclaims all liability arising from the use or misuse of the App, including reliance on any content, wellness information, dietary suggestions, or acupressure point offerings provided through the App.
